Midjourney vs Adobe Firefly: which is right for your business?
Choose Midjourney for the most distinctive, stylised imagery for concepts, mood boards and campaign exploration, accepting that its terms give no IP indemnity and images are public unless you pay for stealth mode. Choose Adobe Firefly when commercial safety matters: Adobe trains its own models on licensed and public-domain content, attaches Content Credentials, and offers IP indemnity to enterprise customers. Firefly also sits inside Photoshop, Illustrator and Express, which makes it easier to move from generation to finished assets.

For Australian businesses
Copyright protection for heavily AI-generated images is uncertain under the Copyright Act 1968, because protection depends on human authorship, so keep records of human editing for key assets. Generated images in advertising must not mislead consumers under the Australian Consumer Law, particularly when showing products or people. Avoid prompts that imitate a real person or a living artist's distinctive style. Both services bill in US dollars, though Adobe Creative Cloud is also sold in Australian dollars. Agencies should check client contracts for AI-use clauses.
Our verdict
For agencies and in-house teams exploring ideas, Midjourney produces the more distinctive images and is worth paying for as a concept tool. For assets that go into paid media, packaging or client deliverables, Adobe Firefly is the safer choice because of its licensed training approach, Content Credentials and enterprise IP indemnity, and because it fits existing Creative Cloud workflows. A sensible split is Midjourney for early concepts and Firefly, or human-made work, for final commercial assets.

Frequently asked questions
Does Midjourney offer IP indemnity?
No. Midjourney's terms disclaim IP warranties and ask users to indemnify Midjourney, so you carry the risk if an image is claimed to infringe someone else's rights. Companies above the revenue threshold set in its terms must also hold a Pro or Mega plan to use images commercially.
Is Adobe Firefly safe for commercial use?
Adobe designs its own Firefly models for commercial use and says they are trained on licensed and public-domain content. Enterprise customers can get IP indemnity for outputs from Adobe's own models. Partner models available inside the Firefly app have their own terms and do not carry the same assurances, so check which model produced each asset.
Can I copyright AI-generated images in Australia?
It is uncertain. Australian copyright law requires a human author, so images generated with little human input may not be protected. Significant human editing, selection and arrangement improves your position. Keep prompts, drafts and editing records for important assets, and seek legal advice where ownership matters.
